Company Names

 

There are many things to consider in choosing a company name here are some of the most important items to consider:

 

  • Is your preferred company name still available?
  • Will you company name be your trade name? - see below
  • Do you want to spend significant sums to explain what the trade of your business is or should you include it for example "Au01 Company Formation Ltd"?
  • If it is important to be the first mentioned company in a directory you should what the method of ranking is: numbers first, alphabetical or sequential based on the time of entry.
  • Will people be able to remember and pronounce it easily?
  • If you trade abroad what does it mean in those local languages?
  • Will you use limited or Ltd at the end of the company name or will you use section 30 of the companies act in case you are a charity?

Check your company name on the left hand and see if it is still available. You should be aware that almost a thousand companies are registered every working day. Unfortunately it is theoretically possible someone else registers the same company just before you do.

Trading names

 

You are free to choose your trading name as long as you don't infringe the rights of others. In particular of those businesses who have registered their trademarks. Contrary to general believe forming a company with a particular name does not mean you have any rights to that particular trademark.

 

You can add the sign to your trademarks to indicate to others that this is your trademark. Any normal business would think twice about using that trademarks. However, there are plenty of less scrupulous individuals who will try to register trademarks and companies with certain names hoping to re-sell these later at highly inflated prices.

 

Many brand management companies distinguish between the legal entity and the brand name. In particular for consumer products and services this can be a useful distinction. This practise is therefore most useful as a risk prevention and privacy seeking strategy.
